This website is operated by Le Bon Wellness Inc., a Texas corporation whose place of business is 4900 Calvert St, Unit D102, Dallas, TX 75247, United States. Throughout these terms, "we," "us" and "our" mean Le Bon Wellness Inc.
We offer this website and everything available through it, together the Services, on condition that you accept the terms, conditions and policies set out here. By using the site or buying from us you agree to be bound by these Terms of Service, including our privacy policy, returns and refund policy, and subscription cancellation policy, each of which forms part of them.
Our store is hosted by Shopify Inc. We sell and ship within the United States and to the United Kingdom. Orders shipped to the United Kingdom are processed through Shopify Managed Markets, with Global-e acting as merchant of record, and are also covered by our UK shipping and returns terms. Nothing in these terms overrides your statutory rights under applicable federal or state law, or, for customers in the United Kingdom, under UK consumer law.
1. Using the site
You confirm that you are the age of majority in your state, or that a parent or guardian has consented. You may not use the Services for any unlawful purpose or transmit malicious code. Breaching these terms may result in your access being terminated immediately.
2. General conditions
We may refuse service to anyone at any time. You agree not to reproduce, duplicate, sell, resell or exploit any part of the Services without our written permission. Content other than payment card data may be transmitted unencrypted across networks. Payment data is always encrypted in transit.
3. Accuracy of information
We work to keep the site accurate and current but do not warrant that it is error-free or complete. Your reliance on site content is at your own risk, and we may change content without notice.
4. Prices and availability
Prices may change without notice. Some products are online only and in limited quantities. Images and descriptions are illustrative and the item delivered may vary slightly. We may limit quantities, restrict sales in certain jurisdictions, and modify or discontinue the Services at any time.
5. Products and returns
By buying from bonwellness.com you agree to our returns and refund policy, which forms part of these terms.
6. Billing and account information
You agree to give accurate, current and complete purchase and account information. We may cancel or limit orders that appear to be placed by resellers or distributors, or for fraudulent purposes.
7. Subscriptions and recurring billing
Where a subscription option is offered on a product page, you can choose to receive that product on a recurring basis. By subscribing you agree that:
- your subscription renews automatically at the frequency you selected, until you cancel it
- each renewal is charged to your saved payment method at the price in effect at the time
- we email you before each renewal charge
- you can cancel at any time, with no minimum commitment and no cancellation fee
- to stop an upcoming order, you need to cancel at least 2 days before your next scheduled delivery date
- you cancel from your own subscription account, and we will never require a phone call or a retention conversation first
- if the price of an existing subscription is going to change, we will email you at least 30 days beforehand and you can cancel before it takes effect
- refunds on subscription orders are handled under our returns and refund policy

8. Payment providers
Payments are processed by third parties such as Shopify Payments, PayPal and Stripe, and by buying from us you also agree to their terms. We are not responsible for errors or disputes arising from third-party payment services.
9. Third-party tools and links
We may give access to third-party tools as they are, without warranties of any kind, and the Services may link to third-party sites. We are not responsible for their content, accuracy or privacy practices, and your use of them is at your own risk.
10. Your submissions
If you send us content such as reviews, feedback or suggestions, you grant us a non-exclusive, royalty-free, perpetual and irrevocable licence to use, reproduce, edit and publish it. You are responsible for the legality and accuracy of what you submit, and we may remove anything that breaches these terms.
11. Personal information
Your submission of personal information is governed by our privacy policy, which forms part of these terms. Residents of California and of other states with applicable privacy laws have additional rights, described there.
12. Errors and omissions
We may correct errors, inaccuracies and omissions at any time, including after an order is placed. Where a product is listed at an incorrect price or with incorrect information, we may cancel or decline to honour orders for it.
13. Prohibited uses
You may not use the site for any unlawful purpose, to solicit unlawful acts, to violate intellectual property rights, to upload malware or interfere with security features, to collect or track other people's personal data without consent, to disrupt the Services, to impersonate anyone, or to carry out automated data collection without our written permission.
14. Fraud prevention and unauthorised returns
We may refuse, cancel or flag for review any order that appears fraudulent, unauthorised or suspicious, and may ask for additional verification before shipping. Products sent to our correspondence address without prior authorisation cannot be accepted or refunded.
15. Health disclaimer
BonWellness products, including BonPatch and BonMelt, are dietary and wellness products. They are not intended to diagnose, treat, cure or prevent any disease. These statements have not been evaluated by the Food and Drug Administration. Speak to your healthcare provider before use, particularly if you are pregnant, nursing, have a medical condition or are taking medication. Nothing on this site is medical advice.
16. Warranties and liability
We do not guarantee that the Services will be uninterrupted, timely, secure or error-free. Products and Services are provided as they are and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent permitted by law, Le Bon Wellness Inc. is not liable for any loss, injury, claim or damage of any kind, including indirect, incidental, punitive or consequential damages, arising from your use of the Services or of products bought through the site. Our total liability to you will not exceed the amount you paid for the product or service the claim relates to. Some states do not allow certain exclusions or limitations, so parts of this clause may not apply to you.
17. Indemnification
You agree to indemnify and hold harmless Le Bon Wellness Inc., its affiliates, partners, employees, contractors and service providers against any claim arising from your breach of these terms, your violation of law or third-party rights, your misuse of the Services, or content you submit.
18. Severability
If any provision of these terms is found unlawful, void or unenforceable, it is severed without affecting the rest.
19. Termination
These terms remain in effect until terminated by you or by us. You may terminate by ceasing to use the Services and closing your account. We may suspend or terminate your access if we believe you have breached them. Provisions that should survive termination by their nature will do so, including those covering ownership, warranty disclaimers, indemnity and limitation of liability.
20. Entire agreement
These terms, together with our privacy policy, returns and refund policy and subscription cancellation policy, are the entire agreement between you and Le Bon Wellness Inc. regarding your use of the Services.
21. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. By using bonwellness.com you acknowledge that the seller of record is Le Bon Wellness Inc., a Texas corporation, and that claims will be resolved under Texas law. Disputes arising from these terms or from your use of the Services are subject to the exclusive jurisdiction of the state and federal courts located in Texas. If you are a consumer in the United Kingdom, you keep the protection of the mandatory consumer laws of the part of the UK where you live, and you may bring proceedings in the courts there.
22. Changes to these terms
We may update these terms at any time. Changes take effect when posted and we will update the date above. Continuing to use the Services after that constitutes acceptance of the revised terms.
23. SMS terms
By opting in to our SMS service you agree to receive recurring text messages from or on behalf of Le Bon Wellness Inc. at the number you give us. Messages may be sent using automated technology and are powered by Recharge, Inc. They may be transactional, such as order updates and account alerts, or promotional, such as offers, product launches and cart reminders.
Your consent is not a condition of purchase and participation is voluntary. Message frequency varies, and standard message and data rates may apply, so check with your carrier. Reply STOP to any message to opt out, or HELP for help, or contact [email protected].
We are not responsible for delayed or undelivered messages, and carriers are not liable for message delays or failures. If your mobile number changes you will need to enrol again. We may change or discontinue the SMS service at any time. How we handle the data is covered in our privacy policy.
